These Terms of Service ("Terms") govern your use of the SearchFlow website at searchflow.ca (the "Site") and describe the basics of our service relationship. SearchFlow is operated by Nicholas Espinoza, a sole proprietorship based on Salt Spring Island, British Columbia, Canada ("SearchFlow", "we", "us", "our").
By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
SearchFlow provides web-design and local-marketing services to businesses across British Columbia, Vancouver Island, and the Gulf Islands. Questions about these Terms can be sent to nic@searchflow.ca.

Content on the Site — including descriptions of our services, results, examples, and any guides or blog posts — is provided for general information only. It is not a guarantee of any particular result and is not professional, legal, or financial advice. We try to keep the Site accurate and up to date but do not warrant that it is error-free or complete.
The Site describes our service offerings and lets you request a quote or book a call. Submitting a form or booking a call does not create a binding contract for services. The specific scope, deliverables, timelines, fees, and terms of any engagement are set out in a separate written client agreement (or proposal / statement of work) that we and the client sign. If anything in these Terms conflicts with a signed client agreement, the client agreement governs for that engagement.
Fees for services are as stated in your client agreement. Payments are processed by our third-party payment provider (e.g. Stripe), and by paying you also agree to that provider's terms. Any satisfaction promise we advertise — such as a "7-day or money-back" guarantee — is a good-faith marketing commitment; its exact conditions and how to claim it are set out in your client agreement or on the relevant offer page, which govern. Except where such a promise or the law applies, fees are non-refundable.
The Site and its content — including text, graphics, logos, and the "SearchFlow" name and branding — are owned by SearchFlow or its licensors and are protected by law. You may not use our branding or copy substantial parts of the Site without our written permission. Ownership of deliverables we create for a client (such as a website or marketing assets) is addressed in the client agreement; until it says otherwise, we retain ownership of work product.
The Site may link to or rely on third-party tools and websites (for example, scheduling, analytics, advertising, and payment providers). We are not responsible for the content, availability, or practices of third parties. Your use of a third-party service is governed by that party's own terms and privacy policy.
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. Please review it to understand how we collect and use your information and your rights under PIPEDA and BC PIPA.
Except as expressly stated in a signed client agreement or as required by law, the Site and any information on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, SearchFlow and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the Site. To the extent we are found liable for anything connected to the Site, our total liability is limited to CAD $100. Nothing in these Terms limits liability that cannot be limited under applicable law. Liability for paid services is addressed separately in the client agreement.
You agree to indemnify and hold harmless SearchFlow and its owner from claims and costs arising out of your misuse of the Site or your breach of these Terms.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree that the courts located in British Columbia have jurisdiction over any dispute relating to the Site or these Terms.
We may update these Terms from time to time. The current version is posted on the Site with a revised effective date. Your continued use of the Site after an update means you accept the changes.
